This Video is about two types of legal custodies available under Cr.p.c. One is police custody and the another is judicial custody.Using one of these custodies with respect to an accused is the discretion of the magistrate. In the absence of bail, these are the two options available to the Magistrate. under the police custody the accused physically will be under the supervision of the police and they are responsible of his well being. on the other hand,in the judicial custody, the accused will be lodged in jail under the supervision of the magistrate far away from police.After the investigation, the police custody of the accused is not necessary and will be refused.During the investigation or after the investigation granting the bail to the accused is the judicial discretion.
